Yes, you can sell your Fresno house after a Notice of Default, and in most cases you can sell it right up until the trustee sale. In California the lender has to wait at least three months after recording the Notice of Default, then give at least 20 days’ notice of the auction. If a sale closes before that date, the loan is paid off in escrow and the equity left over goes to you, not to the auction.

How a Fresno foreclosure timeline actually works

California foreclosures almost always run outside the courts, through the trustee named in your deed of trust. The steps are set by state law, so they look the same whether the house is in Fowler, Sunnyside or north Fresno.

  1. Missed payments. Before anything is recorded, the lender has to reach out to discuss options, and most send a breach letter after two or three missed payments.
  2. Notice of Default. The trustee records it with the Fresno County Recorder and mails you a copy. This starts the clock.
  3. The three-month window. The lender can’t schedule a sale until at least three months after the Notice of Default is recorded. This is usually the best time to act.
  4. Notice of Trustee Sale. It sets the auction date at least 20 days out, and it’s posted on the property and published in a local paper.
  5. The auction. If nothing changes, the house is sold to the highest bidder, often for well under what it’s worth.

You can usually bring the loan current (reinstate it) up to five business days before the sale. Selling the house is another way out, and it works even when catching up isn’t realistic.

Can I sell my house after a Notice of Default in California?

Yes. A Notice of Default doesn’t stop you from selling. Your lender gets paid what it’s owed out of escrow on closing day, along with any back interest and fees, and the rest is yours. The catch is time. A listing that takes 60 to 90 days to sell, plus another 30 to 45 days in escrow, can run straight into the auction date. That’s where a cash buyer helps.

In most cases, yes. At the auction you don’t get to set the price, and any equity above the debt can get eaten up by fees and a low bid. A sale before the auction lets you choose who buys, when you close, and what happens to the equity. A foreclosure also stays on a credit report much longer than a late payment history does.
